Attorney General Curtis Hill wants the U.S. Supreme Court to decide whether a South Bend clinic that performs abortions will stay open.
Whole Woman’s Health Alliance first tried to open a clinic in South Bend in 2017. But the state wouldn’t give it a license – it said the organization’s application was incomplete and inaccurate.
An administrative appeal failed. The Alliance tried a second time to apply – and after being rebuffed by the state again, it sued.
Both a federal district judge and the Seventh Circuit Court of Appeals sided with the Alliance. The courts said the state was being unreasonable and allowed the South Bend facility to open.
Attorney General Curtis Hill has now appealed the case to the U.S. Supreme Court.
Indiana already has another abortion case pending at the high court – a lawsuit challenging a 2017 law forcing women to have an ultrasound at least 18 hours before an abortion.
